Subject: Clarification on deletion of name of daughter from the family details of a Central Government pensioner.

The undersigned is directed to say that the Department of Pension and Pensioners’ Welfare has notified the Central Civil Services (Pension) Rules, 2021 in supersession of the Central Civil Service (Pension) Rules, 1972.

2. Rule 50 (15) of the CCS (Pension) Rules, 2021 provides that as soon as a Government servant enters Government service, he shall give details of his family in Form 4 to the Head of Office, which shall include all relevant details relating to spouse, all children, parents and disabled siblings (whether or not eligible for family pension). ‘This Rule further provides that the Government servant shall submit the up to date details of the family in Form 4 again along with the pension papers, before retirement from Government service.Family vacation packages

3. References were received seeking clarification in respect of deletion of name of the daughter from the details of family members after retirement of the Government servant.

4. It has been clarified by this Department vide OM No. 3(2)/2022-P&PW(II)-7942 dated 07-10-2022 that the Government servant/pensioner shall submit details of all member of family whether or not eligible for family pension. The daughter is deemed to be a member of the family of Government servant as and when intimated by the Government servant in the prescribed proforma. Hence, the name of the daughter shall remain included in the details of family members. The eligibility for family pension would be decided after demise of pensioner/family pensioners in accordance with the existing rules.

5. All Ministries/Departments are requested that the above provisions may be brought to the notice of the personnel dealing with the pensionary benefits in the Ministry/Department and attached/subordinate offices thereunder for compliance.

विषय : केंद्र सरकार के पेंशनभोगी के कुटुंब के ब्यौरे से पुत्री का नाम हटाने पर स्पष्टीकरण।

अधोहस्ताक्षरी को यह सूचित करने का निदेश हुआ है कि पेंशन एवं पेंशनभोगी कल्याण विभाग ने केंद्रीय सिविल सेवा(पेंशन) नियमावली, 1972 का अधिक्रमण करते हुए केंद्रीय सिविल सेवा (पेंशन) नियमावली, 2021 को अधिसूचित किया है।

2. केंद्रीय सिविल सेवा(पेंशन) नियमावली, 2021 का नियम 50(15) के अनुसार जैसे ही सरकारी कर्मचारी सरकारी सेवा में प्रविष्ट होता है, वह अपने कुटुंब के ब्यौरे प्ररूप 4 में कार्यालय अध्यक्ष को देगा, जिसमें पति/पत्नी, सभी बच्चों, माता-पिता और नि:शक्त सहोदरों(कुटुंब पेंशन के लिए पात्र हो या न हो) से संबंधित सभी सुसंगत ब्यौरे सम्मिलित होंगे। इस नियम में आगे उपबंधित है कि सरकारी कर्मचारी, सरकारी सेवा से सेवानिवृत्त होने से पूर्व, पेंशन पत्रों के साथ प्ररूप 4 में कुठुंब के अद्यतित ब्यौरे प्रस्तुत करेगा।

3. इस विभाग को ऐसे कई संदर्भ प्राप्त हुए हैं जिनमें सरकारी कर्मचारी की सेवाननिवृत्ति के पश्चात कुठुंब के सदस्यों के ब्यौरों में से पुत्री का नाम हटाने के बारे में स्पष्टीकरण मांगा गया है।

4. इस विभाग के दिनांक 07-10-2022 के कार्यालय ज्ञापन संख्या 3३(2)/2022- पी&पीडबल्यू(एच)-7942 द्वारा यह स्पष्ट किया गया है कि सरकारी कर्मचारी/पेंशनभोगी को कुटुंब के सभी सदस्यों के ब्यौरे प्रस्तुत करने होंगे, चाहे वे कुटुंब पेंशन के लिए पात्र हो या न हो। निर्धारित प्रोफार्मा में सरकारी कर्मचारी द्वारा सूचित किए जाने पर ही पुत्री को सरकारी कर्मचारी के कुटुंब का सदस्य माना जाता है। अतः पुत्री का नाम कुटुंब के सदस्यों के ब्यौरे में सम्मिलित रहेगा। मौजूदा नियमों के अनुसार पेंशनभोगी/कुटुंब पेंशनभोगियों की मृत्यु होने के पश्चात ही कुदुंब पेंशन की पात्रता निर्धारित की जाएगी।

5. सभी मंत्रालयों/विभागों से अनुरोध है कि उपरोक्त उपबंधों का अनुपालन करने हेतु, इन्हें मंत्रालय/विभाग और उसके अधीन संबद्ध/अधीनस्थ कार्यालयों में पेंशन हितलाभों का निपटान करने वाले कार्मिकों के संज्ञान में लाएं।

Consequent upon implementation of 7th CPC pay structure, there has been number of references from field units inter-alia seeking clarification on continuation/ revision of rate 'two' additional increments (non-absorbable) granted to eligible Nursing Staff of Railways as per Para 160 of IREM Vol.1 1989 (revised edition) and Board's letter RBE No. 33/2012 dated 14.03.2012 (F. No. PC-VI/2010/1/7/5/1).

The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, today approved the Unified Pension Scheme (UPS).

The salient features of the UPS are:

1. Assured pension: 50% of the average basic pay drawn over the last 12 months prior to superannuation for a minimum qualifying service of 25 years. This pay is to be proportionate for lesser service period upto a minimum of 10 years of service.
2. Assured family pension: @60% of pension of the employee immediately before her/his demise.
3. Assured minimum pension: @10,000 per month on superannuation after minimum 10 years of service.
4. Inflation indexation: on assured pension, on assured family pension and assured minimum pension

Dearness Relief based on All India Consumer Price Index for Industrial Workers (AICPI-IW) as in case of service employees

5. lump sum payment at superannuation in addition to gratuity

          1/10th of monthly emoluments (pay + DA) as on the date of superannuation for every completed six months of              service

NOTE-  this payment will not reduce the quantum of assured pension

एकीकृत पेंशन योजना की मुख्य विशेषताएं इस प्रकार हैं:

1. सुनिश्चित पेंशन: 25 वर्ष की न्यूनतम अर्हक सेवा के लिए सेवानिवृत्ति से पहले अंतिम 12 महीनों में प्राप्त औसत मूल वेतन का 50 प्रतिशत। यह वेतन न्यूनतम 10 वर्ष की सेवा अवधि तक कम सेवा अवधि के लिए आनुपातिक होगा।

2. सुनिश्चित पारिवारिक पेंशन: कर्मचारी की मृत्यु से ठीक पहले उसकी पेंशन का 60 प्रतिशत।

3. सुनिश्चित न्यूनतम पेंशन: न्यूनतम 10 वर्ष की सेवा के बाद सेवानिवृत्ति पर 10,000 रुपये प्रति माह।

4. महंगाई सूचकांक: सुनिश्चित पेंशन पर, सुनिश्चित पारिवारिक पेंशन पर और सुनिश्चित न्यूनतम पेंशन पर

5. औद्योगिक श्रमिकों के लिए अखिल भारतीय उपभोक्ता मूल्य सूचकांक (एआईसीपीई-आईडब्ल्यू) के आधार पर महंगाई राहत, सेवा कर्मचारियों के मामले में सेवानिवृत्ति के समय एकमुश्त भुगतान, ग्रेच्युटी के अतिरिक्त, सेवानिवृत्ति की तिथि पर मासिक परिलब्धियों (वेतन + डीए) का 1/10वां हिस्सा, सेवा के प्रत्येक पूर्ण छह महीने के लिए, इस भुगतान से सुनिश्चित पेंशन की मात्रा कम नहीं होगी।
